1. You are responsible for regularly reviewing these terms and conditions and additional terms.
2. You represent that you have read and agree to abide by this Agreement, and that you have read our Disclaimer & Limitation of Liability, Copyright and Privacy Policy notices. Masterliness.com Service is a marketplace that allow members (including us - see EULA ) to buy and sell licenses to use digital items like website themes, components, production music, motion graphics project files, software code, vectors, images and much, much more. Information about a particular item is supplied by the author. The price (if any) and other terms of any sale remain subject to direct negotiation between the buyer and the seller. Masterliness.com does not represent the Buyer or Seller or other users of this website The items on marketplace are owned by the authors. The items on marketplace are uploaded at the direction of the author. We provide the platform services; we do not take ownership of the items. The material that appears on the Masterliness.com Service is for informational purposes only. Despite our efforts to provide useful and accurate information, errors may appear from time to time. Before purchasing goods or services you've read about on the Masterliness.com marketplace, you should confirm with the vendor any information (including the price) that is important to your purchasing decision. Masterliness.com is not responsible for, and does not guarantee the performance of, any such goods or services.
3. REGISTRATION:To use certain features of the Service, you must register with Masterliness.com on the form provided. Membership is free. You must be eighteen (18) years of age or older to be a member of our website and receive membership benefits. If you’re under 18 you will need to get a parent or guardian to buy items or use the account of a parent or legal guardian who is at least 18 years of age, with their permission, and this adult will be responsible for all your activities. Upon discovery of the participation of a person under eighteen years of age in such activities, his/her registration or participation will be canceled immediately and all personal information will be deleted from our files. You agree (a) to provide true, accurate, current and complete information about yourself as prompted by the Service's registration form, and (b) to maintain and promptly update the information you provide to keep it true, accurate, current and complete. If Masterliness.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).    c) Post, transmit, or link to sexually explicit material;
   Impersonate any person, or falsely state or otherwise misrepresent your affiliation with a person or entity;
   d) Post or transmit any advertising, promotional materials, or other forms of solicitation including chain letters and pyramid schemes;
   Intentionally violate any other applicable law or regulation while accessing and using our site;
   e) Post or transmit any file that contains viruses, corrupted files, "Trojan Horses," or any other contaminating or destructive features that may damage someone else's computer.
   f) Harvest or otherwise collect information about others, including e-mail addresses.
   g) Violate any applicable laws or regulations.
   h) Create a false identity for the purpose of misleading others.
   i) Link, display, or advertise (through the use of email addresses, URLs, images, or any other contact information) goods or services for which you are not posting on Masterliness.com.
   j) Post duplicates.
   The Service prohibits the transmission, distribution or posting of any matter or other Entry Data which: (i) Is dangerous, counterfeit or stolen goods.(ii) Advertises goods that do not actually exist. We accept no responsibility for the content of any advertising material published on this web site. When you submit an ad for publication on Masterliness.com, you agree that the advertisement as it appears on Masterliness.com becomes the property of Masterliness.com and you assign all ownership interest in the advertisement as it appears on Masterliness.com under copyright law or otherwise to Masterliness.com.
   Submission of an advertisement does not constitute a commitment to publish the advertisement, and publication of an advertisement does not constitute an agreement for continued publication. Rates and specifications are subject to change.
   
6. IDEA SUBMISION:  Masterliness employs many knowledgeable and creative people. As a result, the vast majority of the new ideas that we consider adopting originate within Masterliness, rather than from those outside of Masterliness. In addition, many of the ideas submitted to the company from outside are already known to us. Therefore, before you submit your idea to us, please understand that we do not provide compensation for those ideas that are submitted to us from outside. We encourage you to protect yourself to your own satisfaction before disclosing an idea to us. For example, you may want to seek patent protection for your idea before submitting it to us.
7. MAILING LISTS - NO SPAM: 
8. a) You are solely responsible for any and all materials you post.
   b) While you retain the rights to your postings, Masterliness.com retains the right to maintain a database of the compilation of all postings, and to use that compilation however it deems appropriate.
   c) There is no right to privacy, anonymity, or confidentiality of mailing list contributions.
   d) Masterliness.com does not monitor postings by mailing list(s) users, and is not responsible for the nature or content of anything posted to the mailing list(s).
   e) Masterliness.com reserves the right to remove, at any time, any or all of your mailing list privileges if Masterliness.com determines, at Masterliness.com sole discretion, that you have violated our standards of behavior.
   f) No unlawful materials may be posted to Masterliness.com mailing list(s).
   g) Repeatedly posting off-topic messages or spamming mailing lists by posting the same message to multiple lists or otherwise deliberately disrupting any mailing list are unacceptable behaviors and will result in termination of your privileges and access to the mailing lists.
   h) Masterliness.com may create new mailing lists or remove or alter existing ones.
   
9. BACK-UP FILES: Masterliness.com will make every reasonable effort to protect and backup data for Client on a regular basis, however Masterliness.com does not guarantee the existence, accuracy, or regularity of its backup services and, therefore, Client is responsible for making back-up files in connection with its use of the Services. Client is solely responsible for independent backup of data stored on our server and network.
   
10. NO RESALE OF SITE: You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Site, use of the Site, or access to the Site, without the express, prior written consent of Masterliness.com in each instance.
    
11. SUSPENSION and/or TERMINATION: Masterliness.com reserves the right, at its sole discretion, immediately and without notice, to suspend or terminate your registration for any reason, your ability to access the Site, your ability to utilize any email services offered on the Site, and/or to remove any User Content, for any reason, including without limitation any breach by you of the Terms of Use or conduct by you that Masterliness.com determines to be inappropriate. You agree that Masterliness.com shall not be liable to you or any third-party for any suspension or termination pursuant to this provision.
    
12. INDEMNIFICATION: You agree to indemnify, defend and hold attorneys, staff, and us and affiliates (collectively, "Affiliated Parties") harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of the Site.
    
13. MISCELLANEOUS: If for any reason any provision of this Agreement is found unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the parties as reflected in that provision, and the remainder of the Agreement shall continue in full force and effect. Any failure of ours to enforce or exercise any provision of this Agreement or related right shall not constitute a waiver of that right or provision.
    
14. JURISDICTION:These Terms of Use will be governed by and construed in accordance with the laws of Romania, without giving effect to any principles of conflicts of laws. You and Masterliness each agree to submit to the personal and exclusive jurisdiction of the courts located in Romania. The United Nations Convention on International Sale of Goods shall not apply to these Terms of Use.
